§ 42-174. Regulated substances.

  • Regulated substances, including degradation and interaction products, shall include the following:

    (1)

    Substances, including degradation and interaction products, which because of concentration, physical chemical characteristics (including ignitability, corrosivity, reactiveness and toxicity) radioactivity, mutagenicity, bioaccumulative effect or persistence in nature, may cause or significantly contribute to the degradation of groundwater resources;

    (2)

    Those substances set forth in the lists, as amended from time to time, entitled:

    a.

    List of Hazardous Waste (40 CFR 261, Subpart D).

    b.

    Hazardous Constituents - Appendix VIII, (40 CFR 261).

    c.

    EPA Designation Reportable Quantities and Notification Requirements for Hazardous Substances Under CERCLA (40 CFR 302.4).

    d.

    Florida Substance List (F.A.C. ch. 38F-41).

    e.

    Superfund Amendments and Reauthorization Act (SARA) of 1986, Section 302, Extremely Hazardous Substances List (40 CFR 300 App. A and B); or

    (3)

    Substances which have known hazardous properties as listed in 40 CFR 302 by the EPA;

    (4)

    Substances that are restricted, use pesticides according to F.S. ch. 487, or which are listed in F.A.C. chs. 5E-2 and 5E-9;

    (5)

    Water which contains total dissolved solids (TDS) in excess of 10,000 parts per million (PPM) or chlorides in excess of 500 PPM; or

    (6)

    The generic items listed as follows and byproducts, reaction products, or waste products generated from the use, handling, storage or production of these items:

    Acid and basic cleaning solutions

    Antifreeze and coolants, new or used

    Arsenic and arsenic compounds

    Batteries

    Brake and transmission fluid

    Brine solution

    Casting and foundry chemicals

    Caulking agents and sealants

    Cleaning solvents

    Degreasing solvents

    Disinfectants

    Electroplating solutions

    Explosives

    Fertilizers

    Food processing wastes

    Fuel and additives

    Glues, adhesive, and resins

    Greases

    Hydraulic fluid

    Industrial and commercial janitorial supplies

    Industrial sludge and still bottoms

    Inks, printing and photocopying chemicals

    Laboratory chemicals

    Metal finishing solutions

    Oils (petroleum base)

    Oils, grease, lubricants

    Paints, primers, thinners, dyes, stains, wood preservatives

    Paint solvent and paint removing compounds

    Pesticides and herbicides

    Photo development chemicals

    Plastic resins and catalysts

    Plasticizers

    Pool chemicals

    Roofing chemical and sealers

    Solders and fluxes

    Tanning industry chemicals

    Transformer and capacitors oils/fluids

    Used batteries
